New laws for electricity pricing in communities with embedded networks

From 25 September 2024, operators and third-party suppliers can only charge up to a set price for electricity that they sell to residents in communities with electricity embedded networks.

Why are the laws changing?

This change will ensure residents in communities with electricity embedded networks:

  • have clarity and certainty about how much they can expect to pay for their electricity, and
  • are not paying excessive electricity charges when compared with residents in communities without an embedded network.

It will also allow operators to recover the costs of maintaining and administering their electricity embedded networks.

The Independent Pricing and Regulatory Tribunal (IPART) will set the maximum prices for each distribution district, which are the areas that different electricity distributors supply.

IPART’s determination of the median retail market offer

The table below lists the determined median market offer for residential customers in each distribution district in NSW (including GST, nominal).

Additional requirements of the Residential (Land Lease) Communities Amendment Act

Operators will also be required to:

  1. give written notice to residents of the charges an operator pays for the electricity they supply to residents through an embedded network, at least once a year.
  2. review and compare the offer under their supply contract with at least one other comparable offer from another electricity retailer. If the contract period is more than two years, then the operator will only need to review the offer after the contract expires, before they enter a new one.

The operator will also need to give each resident written notice of their review. The notice will include the comparable offers considered and the outcome of the review.
