About enforceable undertakings

Enforceable undertakings are one of many compliance tools available to Fair Trading. They may be used independently or in conjunction with other compliance tools. Importantly, a regulated person must agree to an enforceable undertaking.

The reasons for entering into undertakings and the terms of undertakings will vary depending on the legislation under which they are given, as will the methods of enforcing the undertakings. Legislation under which Fair Trading may accept enforceable undertakings includes:

• Australian Consumer Law (located in Schedule 2 of the Competition and Consumer Act 2010 (Cth))
• Charitable Fundraising Act 1991 (NSW)
• Community Gaming Act 2018 (NSW)
• Conveyancers Licensing Act 2003 (NSW)
• Co-operatives (Adoption of National Law) Act 2012 (NSW)
• Fair Trading Act 1987 (NSW)
• Motor Dealers and Repairers Act 2013 (NSW)
• Property Stock Agents Act 2002 (NSW)
