Accessing co-operatives public records 

The public can access documents lodged with NSW Fair Trading on the Public Register upon paying the applicable fee under:

  • The Co-operatives National Law, Regulation 8.2 of the Co-operatives National Regulations sets out the documents that are available on the Register.
  • The Co-operative Housing and Starr-Bowkett Societies Act 1998. Regulation 7 of the Co-operative Housing and Starr-Bowkett Societies Regulation 2005 sets out the documents that are available.

Copies of lodged documents can be obtained by completing the appropriate search request form:

Please note: pre-paid account holders must contact Registry Services for a copy of the appropriate form.

Once you complete the form, follow these steps:

  • Lodge with Registry Services by post to PO Box 22, Bathurst NSW 2795 or email to registrysearches@finance.nsw.gov.au.
  • On receipt, you will be contacted within 3-5 working days regarding the cost or progress of your request. There is no obligation to proceed with the search request and the documents sought may be altered during this time.
  • Once we provide you with a quote for your search request, payment must be made within 28 days either by:
    • mailing a cheque or money order, payable to NSW Fair Trading, to PO Box 22 Bathurst NSW 2795, or
    • completing the Credit card payment form in PDF format (size: 441kb) and mailing or emailing to Registry Services.

Once payment is received, the search results will be forwarded to you by post.

Privacy and personal information

Personal details on documents lodged by co-operatives or co-operative housing societies may be provided to the public by way of a search of the Register, for which fees apply.

Section 10 of the Privacy and Personal Information Protection Act 1998 requires that NSW Fair Trading ensures that individuals are aware that their personal information on the Register may be made available to the public. All information collected by Fair Trading is done so for lawful purposes and in accordance with the appropriate legislation.

The Privacy Act also allows NSW Fair Trading to withdraw personal information from the Register available for public inspection when an individual can demonstrate that their safety or well-being may be affected.

Any person requiring suppression of personal information will be required to fill out the Request for suppression of personal information form.
